CRIMINAL LIABILITY Criminal liability connected to a road traffic accident is personal and therefore rests solely with the driver. It arises: Where provisions of the penal code are violated If the accident causes serious personal injury In case of manslaughter It is not true that it arises for the vehicle owner if the driver has not been identified. Criminal liability is excluded: When the act is not considered a criminal offense When the act is due to force majeure When there is only unintentional damage to property It is not true that it is excluded when damages have been compensated or when assistance has been provided to the victim. Whoever is criminally and civilly liable for a road traffic accident: Is subject to the penalties provided for by the Penal Code Is required to provide compensation for damages If they have violated provisions of the Highway Code, they are also subject to administrative liability and therefore to the relative sanctions May be subject to the suspension, revocation, or review of their driving licence It is not true that they are always subject to preventive detention and that they cannot continue to drive vehicles of the same category.
